A Marion County jail guard faces criminal charges after being accused of soliciting sex from a gas station customer during a sting operation.
Deputy Paul Wagner, 25, was charged Tuesday with official misconduct, a low-level felony, and patronizing a prostitute, a misdemeanor.
Wagner, who has an initial court hearing today, was released from jail Saturday on his own recognizance.
Wagner was in uniform, moonlighting on security duty early Saturday at a Speedway station in the 5100 block of East Washington Street when other Sheriff's Department deputies engineered a sting.
They placed a wire on a 28-year-old woman who had complained that Wagner offered several times to buy food items and cigarettes in exchange for sex acts in his truck, according to a probable cause affidavit; on Saturday, he offered to buy cigarettes and a soda in exchange for oral sex.
Police said the 28-year-old woman is not a prostitute. The deputy recognized the woman from her job as a dancer at a night club, the affidavit says.
Wagner, who joined the department 10 months ago, has been suspended without pay, said Julio Fernandez, the Marion County sheriff's spokesman.
