Former jailer again runs afoul of the law
OAK HARBOR — A former Skagit County Jail deputy is on the other side of the law again facing more assault charges just months after pleading guilty to groping female inmates while on duty.
Anthony Smith, 35, is accused of kissing the 15-year-old daughter of his landscaping boss, who he was working for in Island County as part of a 60-day work release program from the Whatcom County Jail.
Smith appeared in Island County District Court Tuesday, pleading not guilty to a gross misdemeanor charge of fourth-degree assault with a sexual motivation. The Island County Prosecutor’s Office filed the charge earlier this month.
In January, Smith pleaded guilty in Skagit County District Court to two counts of fourth-degree assault with sexual motivation for touching female inmates while he was a corrections officer in Mount Vernon.
Four women told investigators that during the time they were inmates, Smith rubbed their arms and fondled their hands, according to an affidavit written by investigating officers. One of the four women told detectives that Smith touched her breasts.
Judge Warren Gilbert sentenced Smith to two consecutive yearlong sentences and a $5,000 fine, but suspended that punishment provided Smith serve his 60 days of work release at Whatcom County Jail and pay a $250 fine.
Smith’s work release option was revoked in March after he lost his job after his boss’s daughter told her father about the kiss, according to a Whatcom County corrections official.
An affidavit written by investigators with the Island County Sheriff’s Office says Smith’s boss would allow his workers to use the refrigerator and microwave at his home.
During a March 18 visit at the home, Smith kissed his boss’s 15-year-old daughter on the lips, the girl told investigators. He had previously hugged her and kissed her on the forehead, the affidavit states.
After his court appearance Tuesday, Smith was released on his personal recognizance with conditions including having no contact with the 15-year-old girl.
