State inmate charged with intimidation
November 6, 2009
POST-TRIBUNE STAFF REPORT An Indiana State Prison inmate has been charged with intimidation after he wrote a letter to Lake Superior Court Judge Elizabeth Tavitas threatening a magistrate who heard the inmate's civil case.
Oscar Guillen Sr., 52, claimed that Magistrate Nanette Raduenz's dismissal of his civil claims was "totally disrespecting me and my rights." In the rambling letter, which Tavitas forwarded to Indiana State Police on Sept. 11, Guillen threatened to attack Raduenz, claiming her ruling provoked him to "beat the (expletive) out of her. Totally serious."
In addition, Guillen filled out a complaint form dated April 28 with the Indiana Commission on Judicial Qualifications in Indianapolis in which he claims his civil rights were violated.
Referring to Raduenz with a derogatory term, Guillen claims the magistrate altered his complaint and "criminally and illegally manipulated this justice system," the probable cause affidavit states.
Guillen is serving a sentence imposed in June 2004 for battery. His earliest possible release date is Dec. 18, 2010.
The new charge carries a maximum three-year sentence.
